1. Overview
These Terms and Conditions (“Terms”) govern access to and use of LJOutfitters.us, including browsing the website, creating an account, placing orders, and using related content, products, and services made available through the site. By accessing or using the site, a user agrees to be bound by these Terms and by any policies referenced in these Terms, including the Privacy Policy, Shipping Policy, and any posted return or customer service policies.
These Terms are issued by FGS, Inc dba Liberty & Justice Outfitters, a California Corporation (“Company,” “Liberty & Justice Outfitters,” “operator,” “site,” or “store”). 2. Eligibility and Account Use
Use of the site is limited to persons who can form legally binding contracts under applicable law. A user is responsible for maintaining the confidentiality of account credentials and for activity occurring under the user’s account, except to the extent caused by the Company’s failure to use reasonable safeguards.
All information provided through the site must be truthful, accurate, current, and complete. The Company may suspend or terminate access for fraud prevention, unlawful conduct, abuse of the site, security concerns, chargeback abuse, or other material violations of these Terms, subject to applicable law.
3. Orders, Pricing, and Availability
All orders are subject to acceptance, inventory availability, payment verification, and compliance review. The Company reserves the right to refuse, limit, cancel, or correct an order when necessary to address pricing errors, inventory mistakes, suspected fraud, suspected misuse, or legal compliance concerns, provided that the Company acts consistently with applicable California consumer protection law.
Prices, product descriptions, promotional statements, and availability may change without notice. Mandatory charges should not be omitted from advertised pricing except as permitted by law, such as applicable taxes and shipping charges reasonably and actually incurred to ship physical goods to the customer.
4. Payment Methods and Stored Payment Features
Payment must be authorized at checkout using a payment method accepted on the site. The Company may use third-party payment processors and gateways, and payment information may be processed under those providers’ separate terms and privacy practices.
At this time, these Terms do not create or promise any subscription, recurring shipment, membership, or automatic renewal program unless such a feature is expressly offered on the site at checkout or on a dedicated program page. If the site later offers stored payment features, such features will remain subject to the payment processor’s requirements, the checkout disclosures presented to the customer, and applicable law.
5. No Subscription or Recurring Billing Commitment
Unless expressly stated on the site for a specific program, the store does not offer subscriptions, recurring shipments, memberships, or any automatic renewal program through these Terms. No customer will be enrolled in recurring billing unless the customer is presented with clear and conspicuous automatic renewal terms and affirmatively consents as required by California law.
If the Company later adds a subscription or membership feature, the automatic renewal terms, consent flow, acknowledgments, and cancellation procedures should be separately updated to comply with California’s automatic renewal law, including online cancellation requirements where applicable.
6. Product Restrictions, Age-Gating, and Checkout Requirements
Certain product categories offered on the site may be subject to additional legal restrictions, age-gating, destination-based limitations, shipping limitations, identity verification requirements, or other checkout conditions depending on the nature of the product and the customer’s location. The Company reserves the right to cancel or refuse any order that cannot lawfully be completed or that requires additional verification not satisfactorily provided by the customer.
If any product page, category page, or checkout flow contains additional eligibility rules, age restrictions, or compliance requirements, those additional requirements are incorporated into these Terms by reference for that product or transaction. The customer is responsible for reviewing product-specific restrictions before placing an order.
7. Shipping and Delivery
Shipping and delivery estimates are estimates only unless expressly stated otherwise. Delays can occur due to inventory timing, carrier issues, address problems, weather, compliance review, or other factors outside the Company’s reasonable control.
Risk allocation, shipping timelines, and any written warranty timing must be interpreted in a manner consistent with applicable law. Where California law restricts the effect of a timing provision or warranty commencement language, the law controls.
8. Returns, Refunds, Exchanges, Replacements, and Cancellations
All sales are final. The Company does not offer routine returns, refunds, or exchanges for buyer’s remorse, ordering mistakes by the customer, preference changes, or items that are not defective and were correctly shipped as ordered.
If the Company shipped the incorrect item, the customer must contact info@ljoutfitters.us within 10 days of receipt to arrange return shipping instructions for the incorrect item. The Company may require reasonable documentation, including order number, photos, and a description of the issue, before authorizing the return of an incorrectly shipped item.
If the Company confirms that the wrong item was shipped, the Company may, at its option, provide a replacement of the correct item, approve a return of the incorrect item, or issue another appropriate remedy consistent with applicable law. This section is not intended to limit any non-waivable rights a California consumer may have under applicable law.
Orders may be canceled by the Company before shipment for inventory errors, suspected fraud, suspected misuse, pricing errors, or compliance issues. A customer cancellation request placed after an order is submitted is not guaranteed and will be handled only if the order has not already been processed, packed, or shipped.
9. Product Information and Warranties
Product descriptions, images, compatibility notes, and specifications are provided for convenience and should be read together with any product-specific instructions or limitations shown on the site. The Company seeks to avoid misleading statements, but minor differences in packaging, appearance, or manufacturer updates may occur.
Except to the extent prohibited by law, the site and its content are provided on an “as is” and “as available” basis. Nothing in these Terms disclaims any non-waivable consumer warranty rights or other protections that cannot lawfully be disclaimed under California law.
10. Reviews and User Content
Users may submit reviews, comments, images, or other lawful content so long as that content is not defamatory, infringing, fraudulent, threatening, obscene, harassing, or otherwise unlawful. By submitting content, the user grants the Company a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and moderate that content for site operation, customer service, and promotional purposes, subject to applicable law.
Nothing in these Terms is intended to prohibit or penalize a consumer for making lawful statements or reviews about the Company, its personnel, or its goods or services. Any provision that could be interpreted to restrict a California consumer’s lawful review rights shall be interpreted narrowly or severed to remain consistent with California Civil Code section 1670.8.
11. Privacy and Data Practices
Personal information collected through the site is governed by the site’s Privacy Policy. California law requires a commercial website that collects personally identifiable information from California residents to conspicuously post a privacy policy and include required disclosures, including disclosures regarding Do Not Track responses and certain third-party tracking practices where applicable.
These Terms should be interpreted together with the site’s Privacy Policy, and the Company’s actual collection, disclosure, storage, and use of personal information should match the written privacy disclosures posted on the site. If the site uses analytics, advertising technology, embedded third-party tools, or payment vendors, those practices should be described accurately in the Privacy Policy.
12. Intellectual Property
All trademarks, logos, product images, graphics, text, and site design elements on the site, excluding user-submitted content and third-party marks used with permission, are owned by or licensed to the Company and are protected by applicable law. No site content may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed without prior written permission except as allowed by law or ordinary website functionality.
13. Acceptable Use
A user may not use the site to violate any law, interfere with site security, submit false information, scrape or harvest data without authorization, distribute malware, infringe another party’s rights, or engage in abusive, deceptive, or fraudulent conduct. The Company may investigate suspected misuse and take reasonable protective action.
14. Dispute Resolution and Forum
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, except where federal law controls. Unless non-waivable law requires otherwise, any dispute arising from or relating to the site or these Terms shall be brought in the state or federal courts located in California.
These Terms do not presently impose mandatory arbitration. If the Company later wishes to add an arbitration clause or class action waiver, that clause should be separately vetted for California enforceability, fairness, and consumer-law risk before publication.
15. Limitation of Liability
To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to use of the site or products purchased through the site. This limitation applies only to the extent permitted by law and does not waive liabilities or remedies that cannot lawfully be limited.
16. Severability
If any provision of these Terms is found unenforceable, that provision will be enforced only to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Any interpretation of these Terms must preserve non-waivable rights granted to California consumers under applicable law.
17. Policy Alignment and Operational Consistency
These Terms are intended to align with the Company’s Privacy Policy, checkout disclosures, warranty language, shipping policy, customer communications, and promotional claims. The Company’s actual website operations, checkout flow, product restrictions, and post-sale practices should match the language used across those materials because inconsistency can create California consumer-law risk.
If the Company changes its business practices, including offering subscriptions, changing cancellation rights, adding restricted product categories, or revising warranty language, the related policies and disclosures should be updated together so that the site’s written terms remain accurate and consistent.
18. Changes to These Terms
The Company may update these Terms by posting a revised version on the site and updating the “Last Updated” date. Material changes should apply prospectively unless a change is required by law, relates to security or fraud prevention, or must otherwise be implemented immediately for operational reasons.
